    Flataway Terms of Service

    1. Acceptance of Terms
      By registering or using the Flataway platform ("Platform"), you (the "Property Manager") agree to comply with these Terms of Service ("Terms"). If you disagree with these Terms, you must not use the Platform.
    2. Services Provided
      Flataway provides software allowing Property Managers to create branded vacation rental websites and integrate global property listings. Services include secure payment processing, property listing distribution, and website management tools.
    3. User Eligibility
      The Platform is exclusively for Property Managers operating vacation rental properties professionally.
    4. Fees and Payment
      • Onboarding Fee: A one-time fee upon registration.
      • Monthly Subscription: Payable monthly; cancelable anytime.
      • Direct Bookings: No commission; only applicable payment processing fees, outlined clearly on our website.
      • Cross Bookings: 15% commission on bookings from other Property Managers' websites.
      • Earnings: Property Managers earn 5% commission on cross bookings made via their own websites.
      Payments are processed via a verified third-party provider. Flataway deducts applicable fees and commissions before disbursing funds. Direct bookings funds are transferred immediately, while cross bookings funds are transferred within 7 days post guest check-in.
    5. Listing Responsibility
      Property Managers are fully responsible for accuracy and authenticity of their listings. Flataway verifies Property Managers but not individual listings.
    6. Damage Coverage
      Flataway provides up to €1,000 coverage for damages from cross bookings, applicable only if guests refuse responsibility. No coverage for direct bookings.
    7. Cancellation and Refund Policies
      Property Managers set their own cancellation and refund policies. Flataway is not responsible for enforcing or mediating these policies.
    8. Intellectual Property
      Property Managers retain ownership rights of their content (images, descriptions, etc.). They acknowledge and accept that content will be shared across the Platform's network. Flataway has rights to use such content for marketing purposes.
    9. Account Termination and Suspension
      Flataway reserves the right to suspend or terminate accounts at any time without prior notice. Property Managers may appeal via email at hello@flataway.ai.
    10. Dispute Resolution
      Disputes relating to cross bookings are to be resolved between the involved Property Manager, guest, with Flataway acting as mediator. Arbitration under European Union jurisdiction governs these Terms.
    11. Amendments to Terms
      Flataway reserves the right to modify these Terms at any time. Continued use of the Platform after changes indicates acceptance of new Terms.
    12. Governing Law
      These Terms are governed by the laws of the European Union.
